As an example of our creative thinking…

Watson & Watson was hired by a property owner after a foreclosure. This property foreclosure terminated an expressway billboard ground lease. The new owner sought to keep the billboard rental income. The foreclosure was not only due to the failure by the borrower to promptly pay the mortgage payments, but more importantly to regain control of the property to pay the past due property taxes for almost $200K, which were about to trigger a county and city tax sale.

Solution.

A new ground lease to the billboard company was negotiated by Clayton Watson with the billboard company paying advance rent for the first ten (10) years of a twenty (20) year lease transaction. This single advance payment of rent of almost $200K allowed the owner to pay all of the delinquent property taxes and have a larger annual ground rent for the future.
